Please read the below contract and understand its terms before filling out our Application to Adopt a Saint Bernard. The contract is intended to protect the dog and to assure that it is in a home with the proper commitment to the dog's welfare. If you feel you are unable to abide by any of the terms of this contract, please do not waste your time or ours with the application.

ADOPTION CONTRACT

THIS AGREEMENT, made and entered into this day of 20__, relates to the following rescue Saint Bernard and Adopting Person(s):

1. ADOPTING PERSON(S) AGREES THAT THE RESCUE DOG WILL BE A HOUSE PET AND WILL RECEIVE ALL CARE AND ATTENTION NECESSARY TO ENSURE HIS/HER HEALTH AND WELL BEING. Adopting Person(s) will provide adequate food, fresh water, shelter, exercise, veterinary care and yearly inoculations, heartworm test and preventative, and any other treatment as recommended by attending veterinarian, and license said dog in accordance with state and local laws.

2. ADOPTING PERSON(S) WILL NOT PERMIT THE DOG TO RUN FREE OR OFF-LEASH OR OUT OF IMMEDIATE CONTROL. When outside, the dog will NEVER be staked out or chained.

3. PRIOR TO THIS ADOPTION the Adopting Persons(s) will provide fencing around any swimming pool to prevent the dog's entry into the pool area.

4. ADOPTING PERSON(S) will provide indoor sleeping quarters.

5. ADOPTING PERSON(S) WILL NOT transport the dog in an open pickup truck bed.

6. ADOPTING PERSON(S) agrees that the dog will, at all times, wear a buckle collar with current Rabies tag and ID Tag.

7. ADOPTING PERSON(S) agrees to telephone Saint Bernard Rescue Foundation, Inc. . immediately if the Rescue dog becomes lost or is stolen.

10. ADOPTING PERSON(S) will notify Saint Bernard Rescue Foundation, Inc. at least ONE WEEK prior to any change of address.

9. ADOPTING PERSON(S) WILL KEEP THE RESCUE ST. BERNARD FOR SO LONG AS HE/SHE SHALL LIVE AND WILL NOT TRANSFER THE OWNERSHIP TO ANY OTHER PERSON OR ORGANIZATION (INCLUDING ANIMAL SHELTER) FOR ANY REASON.

10. IF CUSTODY (WHETHER PERMANENT OR TEMPORARY) OF THE RESCUE DOG MUST BE RELINQUISHED, Adopting Person(s) agrees to notify Saint Bernard Rescue Foundation, Inc. IMMEDIATELY to arrange for his/her return to Saint Bernard Rescue Foundation, Inc., at the dog owner's expense.

11. THE ADOPTING PERSON(S) TAKES THE RESCUE DOG AS IS WITH ALL DEFECTS EITHER OBSERVABLE OR UNOBSERVABLE, AND ASSUMES FULL RISK FOR THE DOG FROM THE DATE OF SIGNING THIS AGREEMENT. Though care is given to physical condition and temperament evaluation of each St. Bernard that is accepted by Saint Bernard Rescue Foundation, Inc., and every possible effort is made to provide a rescue dog which is compatible with the Adopter's home, no warranty is made as to the physical condition or temperament of this dog. Saint Bernard Rescue Foundation, Inc. Foundation, Inc. HAS OBSERVED THE FOLLOWING CHARACTERISTICS OF THIS DOG'S TEMPERAMENT:

As of the date of this agreement, the Adopting Person(s) assumes responsibility for the dog's actions and shall hold Saint Bernard Rescue Foundation, Inc. FREE from all claims for personal injury, injury to others, and/or property damage associated with this adoption. I understand Saint Bernard Rescue Foundation, Inc. has limited knowledge relating to this dog's health.

LIQUIDATED DAMAGES:

Adopter agrees to pay Saint Bernard Rescue Foundation, Inc. the sum of Five-hundred dollars ($500.00) as liquidated damages in the event the terms of this contract are breached; this liquidated damage value is agreed to for the purpose of establishing value of the animal and does not bar Saint Bernard Rescue Foundation, Inc. from seeking return of the animal by a judicial process or other legal means.

ATTORNEY FEES AND COURT COSTS:

Adopter agrees to pay reasonable attorneys' fees and court costs in the event this matter is forwarded to an attorney for enforcement.

I understand Saint Bernard Rescue Foundation, Inc. will contact me periodically throughout this dog's lifetime and Saint Bernard Rescue Foundation, Inc. may visit this dog at anytime, while in my care, with at least 48 hours prior notice.

I have read every provision above, including the liquidated damages clause. I agree to abide by every provision in this contract. I will have this dog spayed or neutered by the date above.
